TERMS & CONDITIONS

1. These terms and conditions form the complete agreement under which you, as a seller, will do business with us (The Auction Stop). Subject to change we may at any time update these terms and conditions by publishing new terms and conditions on our website at http://www.theauctionstop.co.uk which shall constitute notice to you of any such change. Any new terms and conditions published will supersede these at their time of publication. These terms and conditions are governed by the laws of Scotland. Any dispute shall be subject to the jurisdiction of Scottish Courts.
2. Our services to you. We will hold your items for sale or collect (where agreed) and offer them for auction on eBay. We will prepare the auction listing and answer questions from bidders. we will collect payment from the buyer and pay any fees. We will arrange delivery to the buyer and deal with any returns. Once payment is cleared and the returns period is over (usually 3 days), we will send payment to you less our commission fees.
3. Our fees. Our fees will be as most recently published on our website at http://www.theauctionstop.co.uk and when you sign the lot registration form, unless otherwise agreed in writing.
4. Your obligations. When consigning any of your items for sale, you warrant that they are your own and that you are not constrained from selling them in any way. You will not do or say anything which will interfere with the proper and fair progress of the auction once underway. You indemnify us for any loss or damage due to inaccuracies in your description, or any actions you take which affect the auction.
5. Our liability. We are not liable for any loss or damage - direct, consequential or loss of profit - that you may suffer as a result of this agreement. In particular we make no representation about the selling price of your items. In all cases - except where provided otherwise by statute - our absolute liability shall be limited to the selling price of your items, or agreed start price if unsold.
6. The Company agrees to act as an agent for the Seller. The Company does not buy the lot from the Seller. The Seller remains solely responsible for any: statement which the Seller makes about or description of a lot including but not limited to references as to its ownership, origin, date, age, or authenticity; and faults or defects in any lot; and other things the Seller does or says in relation to the lot including but not limited to any breach of these Terms. The Seller must satisfy itself that the information which the Company records regarding each lot is true and accurate.
